The complainant requested information relating to a Green Paper on a British Bill of Rights. The Ministry of Justice (MoJ) disclosed some information within the scope of the request but refused to provide the remainder, citing sections 35(1)(a) (formulation of government policy) and 42(1) (legal professional privilege) of the FOIA.The Commissioner’s decision is that the MoJ was entitled to apply the exception at section 35(1)(a) of the FOIA and that the public interest favoured maintaining the exemption. She requires no steps to be taken as a result of this decision.
