London Borough of Waltham Forest
The complainant has requested information about an unreasonable behaviour policy. The London Borough of Waltham Forest responded to part of the request but refused the remainder, relying on section 12 of the FOIA (costs) to do so. The Commissioner’s decision is that the London Borough has failed to provide a reasonable estimate of the cost of complying with the request and is therefore not entitled to rely on section 12 of the FOIA. She also finds that it failed to issue a response within 20 working days and thus breached section 10 of the FOIA. The Commissioner requires the London Borough to take the following steps to ensure compliance with the legislation: issue a fresh response to elements [3], [4], and [5] of the request which does not rely on section 12 of the FOIA.
