Cornwall Council
The complainant has requested from Cornwall Council (the Council) information in relation to Council property tenants who have been investigated for unauthorised short-term/holiday lets. The Council provided parts of the information requested and withheld the remainder because it considered that disclosing it would breach data protection principles. The Commissioner’s decision is that the Council was entitled to rely on section 40(2) (personal information) of the FOIA to withhold part of the requested information. The Commissioner does not require any step to be taken as a result of this decision notice.
