The complainant requested information relating to the London Borough of Southwark Council’s (“the Council”) investigations, warnings and penalties regarding Council property tenants involved in unauthorised short-term lets. The Council refused the request, relying on section 12(1) of the FOIA, because it estimated that the cost of compliance would exceed the appropriate limit. The Commissioner’s decision is that the Council was entitled to rely on section 12(1) of the FOIA to refuse the request, and complied with its duty to provide advice and assistance under section 16. The Commissioner does not require the Council to take any steps.
