The complainant requested from the Home Office information concerning the county Police and Crime Commissioner’s proposal to change the governance of the Gloucestershire Fire and Rescue Service. The Commissioner’s decision is that the Home Office partly complied with FOIA in withholding much of the information it held, relying on the section 35(1) and 36(2) FOIA exemptions. However the Home Office must disclose some other information which the public interest balance warrants in accordance with the Commissioner’s determination but with some personal information redacted. The Commissioner requires the Home Office to take the following steps to ensure compliance with the legislation. Disclose the information specified in the confidential annex to this decision notice. The Home Office must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
