Milton Keynes Council
The complainant requested from Milton Keynes Council (the Council) various information relating to a planning application. The Council disclosed some information it held and stated that it did not hold the remainder. The Commissioner’s decision is that the Council has, on the balance of probabilities, disclosed all the information it held within the scope of the request, at the time it was submitted; breached regulation 5(2) of the EIR by failing to provide information it held within 20 working days; and breached regulation 11 of the EIR by failing to conduct an internal review within 40 working days. The Commissioner does not require the Council to take any step as a result of this decision notice.
