Maidstone Borough Council
The complainant requested from Maidstone Borough Council the name of the barrister who was representing the Council on a matter with the intention to initiate a judicial review procedure and some other circumstantial information relating to a planning appeal. The Council provided an explanation but refused to disclose the name of the barrister under regulation 13 of the EIR as it considered it to be the personal data of a third party. The Commissioner’s decision is that the Council was correct to withhold the name of the barrister under regulation 13(1) (personal information) of the EIR. The Commissioner does not require the Council to take any further steps.
