High Speed Two Limited
The complainant has requested risk assessments from High Speed 2 Limited (HS2). HS2 withheld the requested information under regulation 12(4)(d) of the EIR (material still in the course of completion) and said that the public interest favoured maintaining this exception. The Commissioner’s decision is as follows: HS2 correctly withheld the requested information under regulation 12(4)(d) and the public interest favoured maintaining this exception. HS2 breached regulation 14(2) as it did not refuse the request within the required timescale. The Commissioner does not require HS2 to take any remedial steps.
