Royal Borough of Kensington and Chelsea
The complainant has requested information from the Royal Borough of Kensington and Chelsea (the Council). The Council initially refused the request under regulation 12(5)(b) 12(4)(a), regulation 12(4)(e), regulation 12(5)(f) and regulation 13 of the EIR. The Council subsequently sought to rely on the exception at regulation 12(4)(b) on the basis that the request was manifestly unreasonable. The Commissioner’s decision is that the Council is entitled to rely on regulation 12(4)(b), and the public interest in maintaining the exception outweighs the public interest in disclosure. The Commissioner does however find that the Council failed to comply with some procedural requirements of the EIR. The Commissioner does not require any remedial steps to be taken.
