The complainant requested information relating to former prisoners residing at a specified address. The Ministry of Justice (MoJ) provided some information within the scope of the request but refused to provide the remainder, citing section 40(2) (personal information) of the FOIA. The Commissioner’s decision is that the MoJ was entitled to rely on section 40(2) of the FOIA to withhold the requested information within the scope of parts (1) and (2) of the request. The Commissioner requires no steps to be taken as a result of this decision
