The complainant requested a current list of the full names of Magistrates who are currently members of a named Bench. The Commissioner’s decision is that the Ministry of Justice is not entitled to cite section 40(2) (Personal information) FOIA. The Commissioner therefore requires the Ministry of Justice to disclose to the complainant the full names of the Magistrates who, at the date of the information request, were members of the named Bench. The public authority must take this step within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
