City of York Council
The complainant requested from City of York Council (“the Council”) a copy of the advice offered to councillors who sit on the planning committee regarding meeting members of the public. The Council considered the request to be manifestly unreasonable under regulation 12(4)(b) of the EIR. The Commissioner’s decision is that the Council was correct to refuse the request as manifestly unreasonable under regulation 12(4)(b), and that the balance of the public interest favours the exception being maintained. However, the Council breached the requirement, under regulation 14(2) of the EIR, to provide its refusal within 20 working days. The Commissioner does not require the Council to take any steps.
