Durham County Council
The complainant requested from Durham County Council (the Council) information in relation to its child social care, including statistics, policies and procedures in place. The Council refused the request, relying on section 12(1) of the FOIA, because it estimated that the cost of compliance would exceed the appropriate limit. The Commissioner’s decision is that the Council was correct to aggregate the requests submitted by the complainant for the purpose of its cost estimate. The Commissioner also found that the Council was entitled to refuse the requests under section 12(1) of the FOIA and that the advice and assistance it provided was reasonable in the circumstances. The Commissioner does not require any further steps.
