Reading Borough Council
The complainant requested from Reading Borough Council (the Council) information relating to Arthur Hill swimming pool. The Council refused the request under section 43(2) (commercial interests) of the FOIA. The Commissioner’s decision is that the Council was not correct to apply section 43(2) to the information. The Commissioner therefore requires the Council to take the following steps to ensure compliance with the legislation. Disclose the information at part one of the request including the appendices to the report. The Council must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
