Department for the Economy
The complainant has requested information from the Department for the Economy (‘DFE’) in relation to the winding up of a named company. The DFE applied section 14(1) of the FOIA to the complainant’s request. The Commissioner’s decision is that the DFE has incorrectly relied upon section 14(1) of the FOIA in relation to the complainant’s request. Therefore the Commissioner requires the DFE to take the following steps:- Issue a fresh response without reliance on section 14(1). The DFE must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
