Ministry of Justice
The complainant requested information about the Secretary of State for Justice’s decision not to issue, or be a party to, the judicial review proceedings against the Parole Board’s ruling to release John Worboys (a convicted sex offender also known as the ‘Black Cab Rapist’) from prison. The Ministry of Justice (the ‘MOJ’) provided the cost information but refused to provide the legal advice, citing section 42(1) of FOIA – legal professional privilege. The Commissioner’s decision is that the MOJ has correctly withheld the information under section 42 of FOIA. She does not require the MOJ to take any steps as a result of this notice. This decision notice is currently under appeal to the Tribunal.
