Kent Police
The complainant requested information relating to an alleged incident involving a named individual. Kent Police provided links to some relevant information. It refused to confirm or deny holding the information requested at parts 1, 2 and 6 of the request, citing sections 30(3) (investigations and proceedings), 40(5) (personal information) and 24(2) (national security). The Commissioner’s decision is that section 30(3) of the FOIA is engaged and that the balance of the public interest favours maintaining the exemption. Accordingly, Kent Police was entitled to rely on section 30(3) to refuse to confirm or deny whether it held information within the scope of parts 1, 2 and 6 of the request. The Commissioner requires no steps to be taken as a result of this decision
