The complainant’s request concerns information that the Regulator of Social Housing (‘RSH’) used when coming to a conclusion on a complaint he submitted to it about Selwood Housing. RSH released some information and withheld some under section 31 (law enforcement), section 40(2) (third person personal data) and section 42 (legal professional privilege). The Commissioner’s decision is that the information RSH has withheld engages the exemptions under sections 31(1)(g), 40(1) and 40(2) and, with regard to section 31(1)(g), the public interest favours maintaining the exemption. The Commissioner does not require RSH to take any steps to ensure compliance with the legislation.
