West Hampshire Clinical Commissioning Group
The complainant has requested information about Continuing Healthcare. The West Hampshire Clinical Commissioning Group (the CCG) says it is not obliged to comply with the request under section 12(1) of the FOIA, as it would exceed the appropriate cost and time limit to do so. The Commissioner’s decision is that the CCG is not obliged to comply with the request under section 12(1). However, it did not provide the complainant with appropriate advice and assistance in accordance with its obligations under section 16 FOIA. The Commissioner requires the public authority to take the following steps to ensure compliance with the legislation: provide the complainant with advice and assistance in accordance with the CCG’s obligations under section 16 FOIA.
