The complainant has requested the University of Bedfordshire (the university) to confirm whether it uses a private company to carry out certain services. If it does, the complainant has asked to know what the services are, when the contract was let, when it is due to expire and when it is likely to be re-tendered. The university refused to disclose this information, citing section 43 of the FOIA. The Commissioner’s decision is that section 43 of the FOIA does not apply in this case. She therefore requires the university to disclose the requested information to the complainant.
