The complainant has requested information regarding Jobcentre managers visiting 10 Downing Street. The Department for Work and Pensions (DWP) initially informed the complainant that it did not hold the information, however, it subsequently relied on section 12 of the Act as collating the information would exceed the appropriate limit. The Commissioner’s decision is that DWP is entitled to rely on section 12(1) of the Act to refuse to comply with the request, however, she considers that DWP did not provide adequate advice and assistance as required under section 16. The Commissioner requires the public authority to provide the complainant with appropriate advice and assistance to aid him in making a refined request that falls within the appropriate limit. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
