The complainant has requested information about a painting known as ‘the Arnolfini Portrait’ by Jan van Eyck. The National Gallery (‘the Gallery’) has refused to comply with the request, citing section 14(1) of the FOIA (vexatious request). The Commissioner’s decision is that the Gallery: breached section 10(1) of the FOIA as it did not comply with section 1(1) promptly and within 20 working days; and is not obliged to comply with the complainant’s request for information as the request is vexatious under section 14(1). The Commissioner does not require the Gallery to take any steps.
