The complainant has requested information relating to HE’s Asset Support Contracts (ASC contracts) with a number of different contractors. Some information was provided but other information was withheld under section 43 of the FOIA. With regards to the application of section 43 of the FOIA, the Commissioner is satisfied that this exemption applies and that the public interest in favour of disclosure, in this case, is outweighed by the public interest in favour of maintaining the exemption. During the Commissioner’s investigation, the complainant raised concerns that Highways England (HE) holds further recorded information. The Commissioner is satisfied that on the balance of probabilities HE does not hold any further recorded information of the nature specified. The Commissioner does not require any further action to be taken. This decision notice is currently under appeal to the Tribunal.
