The complainant has requested information submitted by former Prime Ministers in relation to their claim for the Public Duty Costs Allowance. The Cabinet Office refused to disclose the information citing section 40(2) and section 41(1) of the Act. The Commissioner’s decision is that the Cabinet Office is entitled to rely on section 40(2) and section 41(1) for part of the requested information but the remaining information should be disclosed. The Commissioner requires the public authority to provide the complainant with the information that falls outside of the exemptions under section 40(2) and section 41(1). The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
