The complainant requested information from the Crown Prosecution Service (the ‘CPS’) relating to a number of deaths at a specified care home. The CPS refused to provide the requested information citing section 30(1)(c) (criminal proceedings conducted by public authorities), section 40(2) (personal information) and section 42(1) (legal professional privilege) of the FOIA. The Commissioner’s decision is that section 30(1)(c) is engaged in respect of the information in its entirety and the public interest favours maintaining the exemption. No steps are required.
