The complainant requested information relating to complaints made against a division of the Probation Service, including complaints made against a named individual. The Ministry of Justice (MoJ) confirmed that it held some of the requested information but that it could not be provided without exceeding the costs limit under section 12 of the FOIA (cost of compliance exceeds appropriate limit). It also neither confirmed nor denied holding information relating to the individual named in the request, citing section 40(5) of the FOIA (personal data). The Commissioner’s decision is that the MoJ correctly applied section 12(1) to the information withheld by virtue of that exemption.
