The complainant has requested information on how to appeal the imposition of a benefit cap. The Department for Work and Pensions (DWP) informed the complainant that it held no information falling within the scope of the request. The Commissioner’s decision is that, on the balance of probabilities, DWP does not hold any further information falling within the scope of the request beyond that which has already been provided. The Commissioner notes, however, that DWP did not confirm or deny holding the requested information within 20 working days and has, therefore, breached section 10(1) of the Act. This decision notice is currently under appeal to the Tribunal.
