The complainant has requested information gathered by Ofsted prior to the publication of its inspection report on The Oldham Academy North (“the School”). Ofsted disclosed some of the information but withheld some under section 40(2) (third party personal data) of the Freedom of Information Act 2000 (FOIA). The Commissioner’s decision is that section 40(2) of the FOIA can only be relied on in respect of some of the information to which it has been applied. As the Commissioner has decided that some of the information is not exempt from disclosure under the FOIA, she requires OFSTED to take the following steps to ensure compliance with the legislation - Disclose the following information to the complainant: The joining instructions for the inspection team (with contact details redacted); The curriculum pathways information 2016-2018 for Intermediate and Aspire groups.
