The complainant requested information relating to briefings prepared for the Home Secretary in April and May 2015 relating to Greville Janner. The Home Office refused to disclose the requested information, citing sections 36(2)(b)(i) and (ii) (inhibition to the free and frank provision of advice and exchange of views)) and 36(2)(c) (prejudice to the effective conduct of public affairs) of the FOIA as a basis for non-disclosure. The Commissioner’s decision is that the Home Office has correctly applied section 36(2)(b)(i) in this case and that the public interest in maintaining the exemption outweighs the public interest in disclosure. The Commissioner requires no steps to be taken.
