The complainant requested information from the London Borough of Waltham Forest (“the Council”) about the performance of a private contractor with regard to a contract for the delivery of a domestic waste management services. The Council withheld part of the requested information under section 43(2). The Commissioner’s decision is that the Council has incorrectly applied section 43(2) to the information that it has withheld. The Commissioner requires the Council to disclose to the complainant the information falling within Part 5(a)-(f) of his request to which it had applied section 43(2). The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
