The complainant has requested the council to disclose the Financial Viability Assessments (FVA’s) it received for the proposed redevelopment of Olive Morris House and a site referred to as the ‘Triangle Site, as part of the councils ‘Your New Town Hall’ (YNTH) project. The council disclosed some of the requested information but withheld other information citing regulations 12(5)(e) and 12(5)(f) of the EIR. The Commissioner’s decision is that the council has applied regulations 12(5)(e) and 12(5)(f) of the EIR appropriately in this case. However, the public interest in favour of maintaining these exceptions is outweighed by the public interest in favour of disclosure. He therefore requires the council to disclose the remaining withheld information.
