The complainant requested information relating to the identity of the certificate provider who signed a Lasting Power of Attorney document. The Ministry of Justice (MoJ) refused the request, relying on section 40(2) (personal information) of the FOIA. The Commissioner’s decision is that MoJ was not obliged to confirm or deny if the requested information was held under section 40(5)(b)(i) of FOIA. The Commissioner requires no steps to be taken as a result of this decision.
