The complainant requested information relating to police officers involved in a murder investigation. Staffordshire Police disclosed most of the requested information, but withheld a minority of it under the exemption provided by section 40(2) (personal information) of the FOIA. The Commissioner’s decision is that Staffordshire Police cited section 40(2) correctly and so it was not obliged to disclose the information that it withheld. The Commissioner has, however, found that Staffordshire Police breached sections 10(1) and 17(1) of the FOIA by failing to respond to the request within 20 working days of receipt, but that breach does not necessitate remedial action.
