The complainant requested information about prisoners’ Incentives and Earned Privileges (‘IEP’) status from the Ministry of Justice (the ‘MOJ’). This request was refused by the MOJ on the basis that the cost of compliance with the request would exceed the appropriate limit under section 12(1) of FOIA. The Commissioner has investigated and has found that the MOJ correctly relied on section 12(1) in refusing to provide the requested information. However, the MOJ failed to provide its refusal to respond within the statutory 20 working days framework and thereby breached section 17(1) of FOIA. He does not require the MOJ to take any further steps.
