complainant has requested information about a legal declaration on a questionnaire. Avon and Somerset Constabulary (“the Constabulary”) refused the request, relying on section 21 of the FOIA (information accessible to the applicant by other means). The Information Commissioner’s decision is that the Constabulary has incorrectly applied section 21 of the FOIA and that the correct response would have been to state that it did not hold the requested information. The Commissioner requires no steps to be taken.
