The complainant has requested information relating to the injury on duty (“IOD”) award review conducted by Avon and Somerset Constabulary (“the Constabulary”). The Constabulary considered that the request was vexatious and relied on section 14(1) of the FOIA to refuse to comply with it. The Commissioner’s decision is that the Constabulary was not entitled to refuse to comply with the request under section 14(1) of the FOIA. The Commissioner requires the Constabulary to disclose to the complainant any recorded information it holds which is relevant to his request or it should issue a new refusal notice which is compliant with the provisions of section 17 of the FOIA. The Constabulary must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
