The complainant has requested copies of lease agreements relating to four local sports facilities, let by Petersfield Town Council (“the Council”). The Council did not hold one of the leases and applied section 43(2) (commercial interests) to withhold the remaining three. The Commissioner’s decision is that section 43(2) is not engaged. The Commissioner requires the Council to disclose to the complainant the information withheld under the exemption at section 43(2), taking steps to redact any personal data contained within it. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
