The complainant requested details about the number of medical members of the Mental Health Review Tribunal who had applied to extend their appointment. The Ministry of Justice (MoJ) provided exact figures where the numbers exceeded five but refused to provide figures less than five on the basis that individuals could be identified and section 40(2) was therefore engaged. The Commissioner’s decision is that MoJ has correctly applied section 40(2) to withhold figures less than five. This decision notice is currently under appeal to the Tribunal. He requires no steps to be taken as a result of this decision.
