The complainant has requested information from the London Borough of Hounslow (“the Council”) relating to a Penalty Charge Notice (PCN). The Commissioner’s decision is that the Council incorrectly handled requests 1 and 12 under the FOIA. These two requests should have been handled under the Data Protection Act 1998 (DPA) as they seek the requesters own personal data. The Commissioner has determined that the Council handled the remaining requests in accordance with the FOIA. However, it failed to provide a full response to the complainant within the timeframe of 20 working days. The Council has therefore breached section 10 of the FOIA. As a full response has now been provided, the Commissioner requires the Council to take no steps.
