The complainant has requested the name of the Prosecutor at a specified case and date. The Crown Prosecution Service refused to provide the information, citing section 40(2) (personal information) of FOIA. The Commissioner’s decision is that the CPS, although correct to withhold the information, should have relied on section 40(5)(a) of FOIA. The Commissioner requires no steps to be taken as a result of this decision.
