The complainant requested information relating to grants of compensation to the family of a man wrongly convicted of murder. The Ministry of Justice (MoJ) provided some information within the scope of the request, but withheld the remainder citing section 40(2) (personal information). The Commissioner’s decision is that MoJ incorrectly applied section 40(2) to some of the requested information. The Commissioner requires MoJ to disclose to the complainant the information identified at paragraph 81 of this decision notice. The MoJ must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
