The complainant requested information relating to guidance on redacting information given to staff involved in handling subject access requests (SARs) made by prisoners. The Ministry of Justice (MoJ) confirmed it held relevant information but refused to provide it, citing section 12(1) of FOIA (cost of compliance exceeds appropriate limit).The Commissioner’s decision is that section 12(1) has not been shown to apply. The Commissioner requires the public authority to issue a fresh response under FOIA.
