The complainant has requested information in relation to actions taken and decisions made about the treatment of a debt that was written off by the public authority. The identity of the debtor organisation was the subject of a separate decision notice where the identity was withheld under section 43 of the FOIA. The complainants request for information is preceded by his summary of some aspects of the decision taken by the Council not to identify the debtor organisation. The Commissioner’s decision is that the council, on the civil standard of the balance of probabilities, does not hold any information relevant to the requests made, but he has also found that the council has breached section 10(1) of the FOIA in regards to this information request.
