The complainant has requested the council to disclose the number of complaints it has received relating to council tax and its decision to refuse interim payments in arrears cases prior to magistrate court proceedings. Initially, the council responded to this request by suggesting that it does not hold the requested information. However, during the Commissioner’s investigation it confirmed that it wished to rely on section 12 of the FOIA. It stated that it was unable to confirm whether it holds the requested information without exceeding the cost limit prescribed by the FOIA. The Commissioner has considered the council’s application of section 12 of the FOIA and he has decided that this exemption applies in this case.
