The complainant requested information from the Crown Prosecution Service (CPS) - namely internal staff correspondence and emails – following a leaked email. The CPS refused to provide the requested information citing section 36(2)(c) of FOIA (prejudice to effective conduct of public affairs). The Commissioner’s decision is that the CPS has correctly applied section 36(2)(c) to the requested information. The Commissioner does not require the CPS to take any steps as a result of this decision notice. Information Tribunal appeal EA/2014/0195 dismissed.
