The complainant has requested information about employment tribunal cases involving MPs. The House of Commons (“HoC”) refused to comply with this request citing section 14(2) (repeated request). At internal review, it also introduced reliance on section 40 (unfair disclosure of personal data) and section 41 (information provided in confidence) as a basis for refusing to provide this information. The Commissioner’s decision is that HoC is not entitled to rely on section 14(2) as a basis for refusing to comply with this request. However, it is entitled to rely on section 40(2) as a basis for refusing to provide the requested information. No steps are required.
