The complainant submitted a number of requests to Cambridgeshire County Council (the Council) regarding the monitoring of the grant it had awarded to a local community transport association, Fenland Association for Community Transport (FACT). The Council provided some of the requested information; explained that some of the requested information was not held; and withheld some information on the basis of section 43(2) (the commercial interests exemption) of FOIA. The complainant disputed the Council’s position that it does not hold any information falling within the scope of requests 4, 5 and 6(c), (d) and (f). He also disputed the Council’s decision to withhold the information sought by request 6(e) on the basis of section 43(2). The Commissioner’s decision is that: The Council does not hold information falling within the scope of requests 4, 5 and 6(c), (d) and (f); The information falling within the scope of request 6(e) is not exempt from disclosure on the basis of section 43(2) of FOIA. The Commissioner requires the public authority to provide the complainant with the information sought by request 6(e). Information Tribunal appeal EA/2014/0186 allowed in part.
