The complainant requested information concerning the lopping of an oak tree. Brampton Primary School (the School) stated that it had provided all the information that it held. However, the complainant considered that further information must be available. The Commissioner’s decision is that the School applied the Freedom of Information Act when considering the request but the information was in fact environmental information. The School should therefore have considered the information under the Environmental Information Regulations 2004. The Commissioner’s decision on the balance of probabilities is that the School does hold further information, within the scope of the request. The Commissioner requires the public authority to disclose the Grounds Maintenance Contract from 2010 and the information contained within the monthly invoices. To disclose the written safety reports on the tagged trees and the invoices or issue a refusal notice in accordance with regulation 14 of the EIR. Information Tribunal appeal EA/2014/0289 dismissed.
