The complainant has requested information relating to the compensation and relocation measures available to residents of a particular area affected by the proposed high speed rail link. HS2 denied holding some of the requested information, this constitutes a refusal under 12(4)(a). It did provide a report captured by request, but withheld some information from that report under the exceptions provided by regulation 12(5)(b) – course of justice and regulation 13(1) – personal data. The Commissioner’s decision is that HS2 did not hold some of the information requested and that it was entitled to rely on the exceptions provided by regulation 12(5)(b) an 13(1) to withhold information from the report. The Commissioner does not require the public authority to take any action. Information Tribunal appeal EA/2014/0220 allowed in part.
