The complainant submitted requests to Dover District Council (the Council) seeking access to two planning files. The Council explained that she had previously viewed these files at its offices, albeit that this could be arranged again. The complainant argued that the Council held further information concerning these files than she had previously been able to view. During the course of the Commissioner’s investigation, the Council disclosed one further document to the complainant. The complainant maintained that the Council still held further information falling within the scope of her requests. However, the Commissioner has concluded that on the balance of probabilities the Council does not hold any further information falling within the scope of her requests beyond that previously disclosed to her or which she has been able to inspect at the Council’s offices.
